Three Attica inmates are charged with murder in the stabbing death of another inmate last May 8 while all were in a prison recreation yard.
Shawn Avery, 35; Bruce Battle, 33; and Devin Gray, 22, are each charged with second-degree murder and conspiracy for plotting and carrying out the fatal stabbing of Rodney Calloway, 26. Calloway, who had been in the prison less than a year, was serving a 20-year sentence for assault and robbery out of Kings County.
According to information from District Attorney Donald G. O’Geen, Calloway was stabbed in the heart while outside in the “A” yard of Attica Correctional Facility, a maximum security state prison.
O’Geen attributed the length of the investigation partly to “the large volume of potential witnesses.”
The three defendants were arraigned Thursday before Judge Michael M. Mohun in Wyoming County Court.
Mohun set bail for each at $500,000 cash or $1 million bond. All three have time remaining on the current sentences, but authorities say they set bail as a precaution, in case their current sentences are overturned or vacated on appeal.
Avery is serving a sentence for manslaughter and is from Queens. Battle, from Kings County, is imprisoned on burglary charges, and Grey, from Ulster County, began serving a 15-year weapons sentence at the prison in March 2015.
The case returns to court June 1.
