Lewiston restaurant owner spared prison in tax fraud

Jon DiBernardo, 51, a Lewiston resident and owner of the popular Water Street Landing, a restaurant overlooking the Niagara River in Lewiston, was spared a prison term Thursday as he continues to repay the Internal Revenue Service for the $419,221 in unreported taxable income his business took in between 2006 and 2009. U.S. District Judge Richard J. Arcara placed him on probation for three years.

This past September DiBernardo pleaded guilty to tax evasion and made an initial payment of $200,000 to the government. His conviction was the result of an investigation by the Internal Revenue Service’s Criminal Investigations Division.
