LOCKPORT – A man who fractured his sister’s eye socket and left her with a brain bleed in a 2014 robbery attempt was sentenced Monday to five years’ probation, beginning with a six-month Niagara County Jail term.
In November, Brandon S. Smith, 29, of Pine Street, Lockport, had pleaded guilty to second-degree assault in exchange for the sentencing promise from County Judge Sara Sheldon. Monday, Smith said through his attorney, Assistant Public Defender Matthew P. Pynn, that he wanted to withdraw his guilty plea, but a few minutes later he changed his mind and accepted the sentence.
Sheldon issued a restraining order barring Smith from any contact with his sister, who was hurt in the Nov. 22, 2014, Lockport incident. She made drug treatment and anger management courses conditions of his probation sentence. If Smith violates the rules, he risks a prison term of as long as seven years.
