DWI charge lodged against driver who parked next to police cruiser

NIAGARA FALLS - Niagara falls police arrested a North Avenue man just before 9 p.m. Friday after he pulled into a 7-Eleven lot on Pine Avenue and parked next to a police cruiser.

Police said the officer, who had just parked there as well, noticed the driver sipping from a small bottle of Southern Comfort before leaving his vehicle. Police added that the driver had consumed a half-pint bottle of the alcoholic beverage before cracking open another bottle of it after parking.

Johnnie J. Phipps, 36, was charged with driving while intoxicated, third-degree aggravated unlicensed operation and consuming alcohol in a motor vehicle. Police said Phipps failed three sobriety tests, and register a 0.12 blood-alcohol reading on a preliminary breath test.
