LOCKPORT – A Lockport woman admitted in Niagara County Court Friday that she held a 16-year-old girl’s hand and encouraged her as the defendant’s live-in boyfriend had sex with the girl.
Theresa A. Ferguson, 54, of Elmwood Avenue, pleaded guilty to attempted third-degree criminal sexual act and risks up to four years in prison when she is sentenced March 11 by Judge Matthew J. Murphy III.
Assistant District Attorneys Peter M. Wydysh and Laura T. Bittner told Murphy that Ferguson tried to comfort the girl as she was having sex with Kenneth T. Mulcahy Sr., 53, now of Meadville Road in the Town of Alabama. Ferguson and Mulcahy were living together on Jockey Road in Newfane at the time of the July 18 incident.
Mulcahy rejected a plea offer Jan. 19 to a charge of use of a child in a sexual performance, a Class C felony, for having pictures of the sex act taken. Ferguson was in court Thursday but then denied taking part in the incident. She told Murphy Friday that she had balked at admitting anything Thursday because Mulcahy, who is free on $25,000 bail, was in the courtroom. He wasn’t there Friday.
