Inmate admits damaging sprinkler head in Niagara County Jail

LOCKPORT – A Niagara County Jail inmate admitted in County Court Thursday that he broke a sprinkler head in his cell, leading to $7,500 in water damage there and on the floor below the cell.

Daryl A. Smith, 20, of Rapin Pace, Buffalo, faces a sentence of as long as four years in state prison for third-degree criminal mischief. The sentence, to be imposed April 22, could run consecutively to a parole violation sentence Smith is facing for a previous conviction.

Smith at first claimed the sprinkler head simply burst in the July 25 incident, but changed his story after a conference with his attorney, Jenelle Messer, who also got the prosecution to reduce the restitution amount from the original demand of $10,302.
