‘Functioning drug addict’ pleads guilty to having cocaine

LOCKPORT – A Town of Niagara man, described by his lawyer “a functioning drug addict,” pleaded guilty Friday to having nearly three-quarters of an ounce of cocaine when police raided his Lockport Road home on June 24.

Duane S. Mays, 46, who has been through drug treatment before but relapsed, pleaded guilty to third-degree drug possession and was admitted by Niagara County Judge Sara Sheldon to the judicial diversion program. He risks as long as nine years in prison if he washes out of rehab this time.

Mays – married with four children, one of them in college – is able to hold a job, defense attorney James J. Faso Jr. said, although the amount of money he was spending on drugs caused some trouble at home.
