Falls woman charged with Leandra’s Law violation

LOCKPORT – A Niagara Falls mother was arraigned in State Supreme Court Friday on an indictment accusing her of driving drunk with two children as her passengers.

Stefany M. Benton, 22, of 71st Street, is charged with aggravated driving while intoxicated for allegedly violating Leandra’s Law, along with child endangerment, first-degree aggravated unlicensed operation, leaving the scene of an accident and traffic violations.

Deputy District Attorney Theodore A. Brenner told Justice Richard C. Kloch Sr. that Benton allegedly rang up a 0.22 percent blood alcohol reading after she crashed into a parked car Oct. 28 on 71st Street. Brenner said Benton was accused of walking away from the accident, but a witness followed her and pointed her out to police. The passengers allegedly included Benton’s 3-year-old son and a 10-year-old.

In another case Friday, Kloch sentenced Benjamin J. Taylor to three years’ probation and a $1,000 fine for misdemeanor DWI. Taylor, 24, of Quaker Road, Barker, crashed his car into a tree on Quaker Road Nov. 1, 2014.
