LOCKPORT - A burglar who completed the judicial diversion program of court-supervised drug treatment was sentenced to three years’ probation Monday by Niagara County Judge Sara Sheldon.
Phillip S. Muzzy Jr., 32, of South Park Avenue, Lackawanna, took part in a break-in at a convenience store on River Road in Wheatfield April 23, 2013. His third-degree burglary charge was reduced to a misdemeanor, second-degree criminal trespass.
Muzzy also went through diversion in Erie County, where he was recently placed on three years’ probation for charges he incurred after his June 2014 guilty plea to the burglary. State Supreme Court Justice M. William Boller declined to send Muzzy to jail for criminal mischief and assaulting a police officer.
