The contractor that was kicked off the Canalside project midway through construction of the Buffalo waterfront attraction announced Wednesday that it has won a victory in its lawsuit against the Erie Canal Harbor Development Corp. in State Appellate Court.
DiPizio Construction, a Buffalo-based family business, reported that the court called into question the actions of Thomas Dee, president of Erie Canal Harbor, in dismissing the contractor without board approval. DePizio now will seek a jury trial to determine if Dee acted illegally.
DiPizio was dismissed in May 2013 after work on Canalside stalled. The company claimed that it was made a scapegoat for delays that were caused by poor planning and bad management by the agency.
“This is a significant affirmation of what we’ve been saying all along,” company representative Rosanne DiPizio said in a press release, “that we were wrongfully – and unilaterally – kicked off the job by local appointees who wanted to give this contract to their friends and politically connected allies.”
