LOCKPORT – Benjamin N. Carter of Lockport pleaded guilty Wednesday to the same burglary for the second time.
Carter, 26, of Lewis Street, is to be sentenced Jan. 27 for third-degree burglary. He pleaded guilty June 30 to burglarizing a home on Washburn Street in Lockport Feb. 17, and State Supreme Court Justice Richard C. Kloch Sr. assigned him to the judicial diversion program of court-supervised drug treatment. But the program rejected him, because Carter is a Level 3 sex offender for having sex with a 15-year-old girl when he was 18.
This time, Kloch said, he will sentence Carter to one of two special programs in the state prison system: the drug treatment program at Willard Correctional Facility, which lasts three months, or the shock incareration program, which lasts six months. Both are followed by parole from a longer sentence.
