WHEATFIELD – A Buffalo man found asleep Sunday at the wheel of his car in a driveway on Joshua Lane was charged with driving while intoxicated.
Marc J. Maisch, 38, of Edgewater Drive, was charged by Niagara County sheriff’s deputies with felony DWI and failure to use an ignition interlock device. Deputies said he had previously been convicted of drunken driving on March 11, 2014 and his license had been revoked.
A homeowner in the 3300 block of Joshua Lane called about a suspicious vehicle in the driveway at 5:30 a.m. Maisch was found by deputies passed out in the driver’s seat with the car running. Deputies said Maisch was confused about where he was and where he had come from, but admitted he had been drinking. He was found with a blood alcohol level of 0.14 percent, which is above the legal limit of 0.08.
Bail was set at $750 and a court date was scheduled for Wednesday in the Town of Wheatfield.
