David Bellavia claims his wartime experiences in Iraq, the subject of his 2007 book, “House to House,” were ripped off by another author.
Bellavia, in a new lawsuit filed in Buffalo federal court, says the names, descriptions and experiences in “Flesh and Iron,” a 2010 book that is part of the Warhammer 40,000 science fiction series, were taken directly from his book.
He is suing the author and Simon & Schuster, which distributed “Flesh and Iron,” for breach of contract, copyright infringement and fraud. Simon & Schuster also published Bellavia’s book.
In his suit, the highly decorated war veteran from Batavia claims the newer book was so popular, it spawned a video game, as well as action figures and a soundtrack.
For his service in Iraq, Bellavia was awarded the Silver Star and nominated for the Medal of Honor and Distinguished Service Cross. Upon returning here, he entered politics and ran unsuccessfully for Congress.
