Falls man pleads guilty to role in sex case

LOCKPORT – A Niagara Falls man pleaded guilty Tuesday in Niagara County Court to a misdemeanor for his part in an alleged sexual assault on a woman in the Falls on Jan. 20, 2014.

Damien P. Powell, 40, of Pine Avenue, admitted to forcible touching and was scheduled for sentencing July 31 by County Judge Matthew J. Murphy III. Assistant District Attorney Robert A. Zucco said he thought Powell’s admission to fondling the woman included information that might help Zucco convict co-defendant Thomas S. Frazier Jr., 36, of Fifth Street in the Falls, who is under indictment on a first-degree rape charge in the case. Frazier is due to return to court June 16.

Besides the sex offense, Powell also is awaiting sentencing on his guilty plea to attempted second-degree assault for slashing a man with a knife Dec. 31, 2013.
