LOCKPORT – Both sides rested their cases Friday in the attempted murder trial if Javon J. Ellison Sr. of Niagara Falls, and a Niagara County Court jury of seven women and five men will get the case after summations at 11 a.m. Tuesday.
Ellison, 25, is charged with attempted murder, first-degree assault and second-degree criminal possession of a weapon in connection with the June 4 shooting of Jermaine V. Lowe Jr., 24, at 11th Street and Ontario Avenue in the Falls. The defense changed its mind about bringing Lowe, who survived being shot once in the abdomen, from state prison to testify. He’s serving a four-year sentence for two burglaries.
The final day of testimony included the playing of excerpts from six phone calls Ellison made from the Niagara County Jail between June 7 and Aug. 5, which purportedly showed him trying to set up payoffs to witnesses, as a jailhouse informant had testified.
The only eyewitness to the shooting, Lowe’s girlfriend Monique Russell, proved uncooperative on the witness stand Tuesday, although she had previously told police and prosecutors that Ellison was the shooter, and testified to that before a grand jury.
