Traffic stop leads to arrest of motorist with a BAC of 0.25 percent

FREDONIA – A motorist pulled over on Route 5 for traffic violations was found to have a blood-alcohol content of 0.25 percent – more than three times the legal limit, according to State Police.

Matthew Budniewski, 36, of Dunkirk, was stopped Sunday in the Town of Pomfret for following too closely and an unsafe lane change. Police said the trooper noticed a strong odor of alcohol as he interviewed the driver.

After Budniewski failed field sobriety tests, he was arrested and taken to the local barracks. He was charged with aggravated driving while intoxicated – related to the BAC of 0.18 percent or higher, driving while intoxicated, consumption of an alcoholic beverage in a motor vehicle, as well as the two traffic violations for which he originally was pulled over.

Budniewski was issued tickets to appear June 9 in Pomfret Town Court.
