Legal complaint argues the Buffalo School Board makeup is "unconstitutional"

Parent activist Samuel Radford III has filed complaints last week and this week with city, state and federal authorities arguing that the makeup of the nine-member Buffalo school board is unconstitutional because the six district-specific seats on the board violate the Equal Protection Clause of the 14th Amendment.

As noted in today's story, the complaints filed on behalf of parent Patricia Elliott-Patton allege that the makeup of the board was created back when the city had neighborhood schools, as opposed to now, resulting in unequal representation of parents by school board members.

Below is a copy of the complaint filed by the Radford to the state Education Department. Similar complaints were filed with the U.S. Department of Education Office of Civil Rights, the Buffalo Common Council and the city comptroller.
