LOCKPORT – A man charged with the armed robbery of a Lockport gas station was ordered by Niagara County Judge Sara Sheldon to give a DNA sample Wednesday.
Deputy District Attorney Doreen M. Hoffmann said the Jan. 10 knifepoint robbery of a Sunoco station at South Transit and High streets was caught on video, and police followed footprints in the snow to a garbage can, where they found some discarded clothing. The test is to determine if those were the clothes of robbery suspect David P. Smith, 40, who has pleaded not guilty to first-degree robbery and resisting arrest.
Hoffmann said some witnesses testified to the grand jury that Smith was the robber. He was arrested Jan. 18.
