LOCKPORT – The prosecution dropped a drug indictment Wednesday against a state prison inmate from Niagara Falls because his co-defendant pleaded guilty last week and admitted possession of the drugs.
Darnell K. Davis, 21, of Pierce Avenue, thus will not face further court action in connection with a June 4 crack cocaine sale in North Tonawanda. It occurred while Davis and Frank M. Thomas, 34, of Memorial Parkway in the Falls, were out on bail awaiting sentencing for a store burglary to which they had pleaded guilty.
Thomas admitted last week to attempted third-degree criminal sale of a controlled substance and is to have 3 1/2 years added to his seven-year term for burglary and gun possession. Davis is serving time in the “shock incarceration” program for attempted third-degree burglary and is eligible for parole in June.
