North Tonawanda man denies sex abuse, child porn charges

LOCKPORT – A North Tonawanda man was arraigned in Niagara County Court Monday on an indictment charging him with sexually abusing a girl under the age of 11 in that city and taking obscene photos of her on his cellphone.

Kyle A. Elder, 25, whose last address was on Linwood Avenue in North Tonawanda, pleaded not guilty to second-degree course of sexual conduct against a child and use of a child in a sexual performance.

Assistant District Attorney Robert A. Zucco said Elder allegedly abused the girl between April and August 2014. He said the phone and a computer to which Elder had access contained evidence of other child pornography and of possible trading or downloading of such material. “There may be an additional grand jury presentation,” Zucco said.

County Judge Matthew J. Murphy III increased Elder’s bail from $2,500 to $25,000. Assistant Public Defender Matthew P. Pynn didn’t object, saying Elder has nowhere to stay if he is released from jail anyway.
