Falls man takes plea in knifing case

LOCKPORT – Damien P. Powell, charged with slashing a man with a knife on New Year’s Eve 2013, pleaded guilty Monday, the day his Niagara County Court trial was supposed to have started.

Powell, 40, of Pine Avenue, Niagara Falls, admitted to a reduced charge of attempted second-degree assault and faces up to four years in state prison when he is sentenced June 5 by County Judge Matthew J. Murphy III.

Powell, a repeat felon, still faces another indictment accusing him of taking part in a rape Jan. 20, 2014, when he allegedly held a woman down as another man raped her. The other man, Thomas S. Frazier Jr., 36, of Fifth Street, Niagara Falls, also is under indictment in the case.
