A 48-year-old Appenheimer Street man was arrested late Sunday for a second recent beating of the same woman and for allegedly refusing to let her leave that house for medical treatment after an incident there in November.
James B. Gardner was arrested by Police Officers Tommy Champion and Pascal Panaro after his alleged victim, a neighbor, called 911. When the officers arrived shortly after 11:30 p.m. Sunday the woman, bleeding from her forehead, said Gardner also attacked her Nov. 19 and kept her a prisoner for several days before the got medical treatment.
The woman told the officers that days after Garner allegedly choked and beat her she managed to get to the Erie County Medical Center for medical treatment. The woman, allegedly assaulted Sunday night with a gold candle holder was treated at the scene by a medical crew. Gardner was charged in the November incident with unlawful imprisonment, criminal obstruction of breathing, assault in the third-degree and harassment.
For Sunday’s alleged incident he was charged with a felony count of second-degree assault and criminal possession of the candle holder as a weapon,
