A 30-year-old motorist whose vehicle got stuck in a snowbank along Route 104 in the Town of Lewiston was charged with a felony count of driving while intoxicated, according to State Police.
Troopers came across the stuck vehicle Sunday and reported that the driver, Joseph J. Pawlik of Niagara Falls, was swaying back and forth and had slurred speech while they interviewed him. After failing field sobriety tests, Pawlik was taken to the barracks in the Town of Niagara, where he registered a blood-alcohol content of .26, police said.
Pawlik was charged with felony counts of driving while intoxicated and aggravated driving while intoxicated; troopers said he had a previous conviction during the past decade. He also was cited for an unsafe lane change and consuming an alcoholic beverage in a motor vehicle.
Pawlik was issued tickets to appear March 3 in Lewiston Town Court.
