A drug-impaired driver who hit and killed a woman as she unloaded packages from the back of her parked car outside a West Side rental property she owned was sentenced Tuesday to two to six years in prison.
Erie County Judge Kenneth F. Case ordered the prison term for Ian Diebold, 23, of Kenmore, who prosecutors said was impaired by the painkiller fentanyl when he ran into Them Thi Li, a 65-year-old Vietnamese immigrant, on Oct. 13.
Diebold pleaded guilty last month as charged to second-degree vehicular manslaughter.
Prosecutors said Diebold told police he was on his way to buy some heroin and became distracted when he dropped his cellphone during a call to his drug dealer.
He hit the woman, pinning her between her car and his SUV on Grant Street, prosecutors said. The impact crushed her legs.
Her boyfriend, who was on the sidewalk, yelled at the driver to back up, and the woman fell to the ground. She was rushed to Erie County Medical Center where she died.
