Tonawanda man pleads guilty in child porn case

LOCKPORT – Donald J. Schwartz, 34, of Maple Street, City of Tonawanda, pleaded guilty Friday in a child pornography case in Niagara County.

Schwartz admitted to a reduced charge of attempted promoting a sexual performance by a child, and is to be sentenced April 28 by County Judge Sara Sheldon.

Deputy District Attorney Holly E. Sloma said Schwartz knows a Town of Niagara teenager who is currently on interim probation, trying to earn youthful offender status in a child porn case. Schwartz emailed himself a photo of a nude girl under age 10 from the teenager’s computer in the Town of Niagara on June 20, 2012.

Sheldon noted that Schwartz is receiving sex offender counseling, and if that continues to go well, “I’m not going to interrupt that treatment by sending you to state prison.” Four years behind bars would be the maximum sentence, but 10 years’ probation is an option.
