Prison term ordered for man in rape case

LOCKPORT – A Lockport man who pleaded guilty to having sex with a 16-year-old girl was sentenced Thursday to two years in state prison and 10 years of post-release supervision.

“You raped this girl. She didn’t want it,” State Supreme Court Justice Richard C. Kloch Sr. told Damian J. Fuller, 26, of Saxton Street, who had pleaded guilty to third-degree rape for the incident on the night of Nov. 1-2, 2013. The girl was under the age of sexual consent, which is 17 in New York State.

Kloch concluded that Fuller’s actions were caused by drinking. “You should never have a drop of alcohol again, because you will reoffend,” Kloch told Fuller.
