Hit-and-run Orchard Park driver has .28 alcohol level

An Orchard Park driver whose blood alcohol content was more than three times the legal limit, fled the scene of an accident early Saturday, according to Orchard Park police who charged the man with aggravated driving while intoxicated.

Donald Weaver, 26, was traveling on Michael Road shortly after midnight, ran a red light at Southwestern Boulevard and collided with another vehicle, police said.

After pausing momentarily, Weaver drove away with a flat tire and significant front-end damage, police reported. The driver of the second vehicle followed Weaver to his home on Countryside Lane, said police who stopped Weaver as he pulled into a parking lot.

Weaver was returned to the Orchard Park Police Department where a breath test indicated a 0.28 BAC. The legal limit is 0.08.

Weaver, who was also charged with leaving the scene of an accident, was released on bail pending arraignment in Orchard Park Town Court.
