LOCKPORT – One year in the Niagara County Jail was the sentence Monday for a Level 2 sex offender who admitted violating the terms of his probation.
Leeverne Holland, 52, of Zito Drive, Niagara Falls, was sentenced on his original guilty plea to second-degree course of sexual conduct against a child. He had several incidents of sexual contact with a then-11-year-old girl in 2001, and was placed on 10 years’ probation by County Judge Matthew J. Murphy III in December 2009.
Murphy said from the bench that Holland committed several “technical violations” of probation. He was accused of having pornographic DVDs, but it appeared the disc in question was of the movie “Monster’s Ball,” for which actress Halle Berry, featured in a lengthy sex scene, won an Academy Award.
Holland also had a copy of Jet magazine that included a photo of a woman in a bikini, defense attorney Angelo Musitano said. Holland said he had contact with relatives under age 18 after his mother died.
Holland also said after a polygraph test last year that he enjoyed driving around and looking at young girls, Murphy said from the bench. Deputy District Attorney Holly E. Sloma said Holland was going to Walmart to check out girls “as a coping mechanism.”
