Delevan man shot with rubber bullet during fight resulting in two arrests

DELEVAN – A Delevan man was shot with a rubber bullet from a shotgun during a fight Friday on Cobb Avenue, authorities said.

Jared Warzen, 21, who was charged with second-degree assault, obstructing governmental administration, resisting arrest, harassment and third-degree assault, was taken to Bertrand Chaffee Hospital, then Erie County Medical Center in Buffalo, where he was treated for undisclosed injuries and discharged, authorities said.

State police based at Machias said Warzen was fighting with several other people, then fought with the troopers while being taken into custody. Police said the gunman, Jaun-Luc Baker, 22, also of Delevan, was charged with second-degree assault, criminal possession of a weapon and second-degree reckless endangerment. He suffered an injury to his face while fighting with Warzen, police said.

Both Warzen and Baker were arraigned in Town of Yorkshire Court and are in Cattaraugus County Jail in lieu of $25,000 bail.

One trooper suffered wrist and back injuries. State police were assisted by the Cattaraugus County Sheriff Office and the Delevan and Machias Fire departments.
