A Niagara Falls company pleaded guilty this week before U.S. Magistrate Judge Hugh B. Scott to negligent endangerment under the Clean Air Act.
Tier NY LLC, which is in the business of cleaning tanks that once housed hazardous materials, faces up to $200,000 in fines.
Assistant U.S. Attorney Aaron J. Mango said the conviction stems from an incident in June 2013, in which company employees cleaned a tank that contained titanium tetrachloride.
Mango said workers used a solution during the cleaning that caused the release of hydrochloric acid gas, which then travelled to a nearby business and placed other people at risk.
Tier NY’s conviction is the result of an investigation by the U.S. Environmental Protection Agency, Criminal Investigation Division, and New York State Department of Environmental Conservation Police.
