Gas theft results in additional DWI charge

State police arrested one man Friday for driving away from a Gowanda gas station without paying for almost $50 worth of gas and then arrested the man who picked him up at the Collins State Police Barracks and charged him with driving while intoxicated.

Michael Orazio, 43, of Falconer, was charged with petit larceny, according to state police.

A customer at the gas station saw the incident, followed Orazio’s car and communicated his location to police. A state environmental conservation officer who was monitoring the police radio stopped Orazio’s car in Kennedy, state police said.

Troopers took Orazio for processing to the Collins Barracks, where Anthony Boris of Eden arrived to pick him up.

Boris smelled of alcohol, and an open can of beer was found in his car, troopers reported. Boris, 46, then told troopers his driver’s license was suspended, police said. After failing sobriety tests, Boris was charged with DWI. He had a alcohol blood-level of .10 percent, police said.

Both men are scheduled to appear in Collins Town Court later this month.
