Benderson and the contaminated berm

As we reported Wednesday night, Benderson Development wants to build a 65,000-square-foot addition to the Tops and Target plaza on Niagara Falls Bouelvard.

The company says it needs the city to give up its rights to an undeveloped portion of 76th Street in order for the project to happen.

Benderson says it needs more land because it needs to move a berm containing contaminated material that's already on the property (pictured in the background above).

Benderson's James A. Boglioli said he did not know what type of contamination was in the berm, only that it was moved from another area of the site when the foundations for the plaza were dug.

Boglioli told the board the berm is about 12- to 15-feet high, though the height is visibly larger than 15 feet.

There may be additional contaminated soil added to the berm depending on whether any further contamination is found at the planned expansion site, Boglioli said.

The Planning Board next meets May 14, when it is expected to make a recommendation to city lawmakers on whether to abandon the land.
