Depew man draws five-year sentence for gun possession

LOCKPORT – A Depew man, who had an illegal gun in the car he was driving when Niagara Falls police pulled him over July 10, was sentenced Monday to five years in prison by Niagara County Judge Sara Sheldon Farkas.

Eric J. Kinney, 33, of Williams Street, had pleaded guilty Oct. 2 to a reduced charge of attempted second-degree criminal possession of a weapon.

Assistant District Attorney Peter M. Wydysh said police also seized drugs and $625 in cash from Kinney. Assistant Public Defender Michael E. Benedict said Kinney was driving someone else’s car and didn’t know the gun was in the trunk. He said Kinney was on his way to buy drugs when he was stopped.

Farkas said she hopes Kinney is assigned to Marcy Correctional Facility, which she said has a good program for treating inmates who have both mental health and substance abuse problems.
