Construction work at the Maid of the Mist boat dock and storage facility in the Niagara Gorge will be allowed to continue, the state Appellate Division in Rochester has ruled.
The Niagara Preservation Coalition had sought an injunction to stop the work, a request which the court denied in a written ruling dated Tuesday and obtained Thursday by The Buffalo News.
The coalition, which had twice before asked judges to put a halt to the construction, argued that “significant historic building remnants” were seen being removed from the site, which is the former site of the Schoellkopf Power Station, which is on the National Register of Historic Places.
The group also argued that the New York Power Authority failed to follow its own guidelines for how to handle “unanticipated” items when found.
The case was taken up by the court on Monday, the final day it heard cases until September.
