Machias man sentenced for DWI

A Machias man faces more than four years in prison following sentencing in Cattaraugus County Court for driving while intoxicated.

David L. Smith, 38, held in the county jail, was sentenced Dec. 13 by Judge Terrence Parker to serve 1 1/2 to 4 1/2 years in prison and fined $2,000 for his conviction of DWI on Nov. 25, 2010, in Yorkshire and while he was driving with a blood alcohol content of 0.15 percent, nearly twice the legal limit.

In other County Court matters:

* A Salamanca man faces two consecutive terms of up to six years in prison for drunken driving following his sentencing Tuesday.

Daniel S. Smrek, 46, was sentenced by Judge Larry M. Himelein to serve two consecutive sentences of two to six years for his convictions of driving while intoxicated March 3 in Great Valley, April 28 in the City of Salamanca and for second-degree unlicensed operation and May 7 in Salamanca for DWI.

* A Salamanca man who tried to sell cocaine in his home town was sentenced Tuesday to probation.

Raymond A. Turner, 32, was sentenced to five years' probation for his guilty plea to third-degree attempted criminal sale of a controlled substance Sept. 25, 2009, in Salamanca.

* An Ellicottville woman arraigned Tuesday pleaded not guilty to aggravated driving while intoxicated and with a blood alcohol count of 0.34 percent, more than four times the legal limit.

Barbara J. Robinson also entered the plea to additional grand jury charges of DWI, failure to keep right and no headlamps May 12 in the Village of Ellicottville.

* An Olean man pleaded guilty Monday to attempting to sell drugs in the City of Olean on March 15.

Freddie Pace, 51, pleaded guilty to fifth-degree attempted criminal sale of a controlled substance, Xanax pills. His sentencing is scheduled for March 15.
