Thief gets up to 4 years in Cattaraugus County

LITTLE VALLEY -- A Bradford, Pa., man was sentenced Monday in Cattaraugus County Court to serve up to four years in prison for a burglary in the Town of Carrollton.

John T. Johnston, 36, was sentenced by Judge Larry M. Himelein as a repeat felon to serve two to four years in prison for his convictions of third-degree attempted burglary and petit larceny. The incident took place July 27, 2008, at a building. His prior felony conviction was in Florida.

In other court action:

*Jeffrey A. Heater, 38, of Delevan, was sentenced to 1 1/2 to 4 1/2 years in prison and fines of $2,500 for his convictions of driving while intoxicated and driving without a license June 5, 2008, in the Town of Yorkshire.

*Alyza A. Bowen, 27, of Salamanca, now in the county jail, was sentenced to two terms of six months in jail and five years' probation after she was convicted of first-degree aggravated criminal contempt and first-degree criminal contempt. On April 6, in the City of Salamanca, she violated an order of protection set in place from her first conviction March 5 in County Court when she pleaded guilty to first-degree criminal contempt.

*Zachary R. Loop, 21, no known address, was sentenced to six months in jail and five years on probation for his conviction of third-degree attempted criminal sale of a controlled substance. He was accused trying to sell cocaine Oct. 9 in the City of Olean, authorities said.

District Attorney Edward M. Sharkey said several others pleaded guilty and sentencing dates were scheduled:

*Joseph W. Westfall, 19, of Farmersville, pleaded guilty to third-degree attempted burglary April 26, 2008, at a building in the Town of Yorkshire. Sentencing will be Dec. 21.

*Andrew DuPont, 19, of Salamanca, pleaded guilty to fifth-degree criminal sale of a controlled substance. He sold LSD on Oct. 2, 2008, in the City of Salamanca. He will be sentenced Nov. 23.

*Joshua S. Harting, 29, of Little Valley, pleaded guilty to fourth-degree grand larceny and fourth-degree criminal possession of stolen property. He was charged with having a stolen credit card in his possession in April in the Village of Little Valley. He will be sentenced Nov. 23.

*Jonathan M. Myers, 18, of Lakewood, pleaded guilty to two counts of third-degree burglary and third-degree criminal mischief Feb. 9 and 20 in the Town of South Valley when a building was entered and damaged. He's to be sentenced Jan. 4.

Others were arraigned and entered pleas of not guilty, Sharkey said:

*Jason R. Mooney, 23, of Portville, pleaded not guilty to DWI, driving without a license and failure to keep right March 16 in the City of Olean.

*Zachariah A. Fasso, 28, of Gowanda, pleaded not guilty to second-degree burglary and fourth-degree grand larceny May 12 at a house in the Town of Persia.
