Theft from bar brings term up to 3 years

A Randolph man faces up to three years in prison following sentencing in Cattaraugus County Court for stealing from the Gin Mill Bar in Ellicottville last year.

Austin W. Slater, 21, who is being held in the County Jail, was sentenced by Judge Larry M. Himelein as a repeat felon to serve 1 1/2 to three years in prison. He also was ordered to make restitution for his conviction on fourth-degree grand larceny Nov. 29 for stealing items valued at more than $1,000 from the bar.

District Attorney Edward M. Sharkey said Slater also was sentenced to serve a concurrent six months in jail for his conviction on second-degree criminal trespass July 1 at Twilight Lanes in Randolph.

In other court action:

Joshua D. Evans, 26, of Bolivar, was sentenced to serve one to three years in prison and fined $2,000 for his conviction on driving while intoxicated. He was also fined $500 for driving without a license, both on April 1, 2006, in the City of Olean.

James R. Frazier, 44, of Ellicottville, was sentenced to one to three years in prison and fined $1,000 for his conviction on DWI April 26 in the Town of Franklinville.

Ashley M. Jones, 24, of Bradford, Pa., was sentenced to a year in jail for her conviction on seventh-degree criminal possession of a controlled substance Aug. 16 in the Town of Great Valley.

Jeffrey Zink, 48, of Little Valley, was sentenced to a year in jail for his conviction on fourth-degree grand larceny between July 1 and Aug. 6, 2006, in the City of Salamanca, where he stole items valued at more than $1,000.

William M. Frazier Jr., 28, of Bradford, Pa., was sentenced to four months in jail, five years' probation and fined $1,000 for his conviction on second-degree attempted assault, third-degree criminal mischief and DWI Aug. 26 in the Town of Carrollton, where he drove his vehicle into the front of a bar and struck a pedestrian.

Brian D. Fidurko, 22, of Olean, was sentenced to five years' probation, including community service, and fined $2,500 for his conviction on DWI Feb. 17, 2006, in Olean.

Sidney J. Horton, 49, of Salamanca, was sentenced to five years' probation and fined $4,000 for his conviction on DWI and traffic violations Feb. 3, 2006, in the Town of Little Valley.

Joshua Keim, 23, of Olean, was sentenced to five years' probation, including 200 hours of community service, for first-degree reckless endangerment April 15, 2006, in Olean, where his conduct created a risk of death to another person.

Michael J. Puvel, 42, of Salamanca, was sentenced to five years' probation and fined $3,000 for his conviction on DWI Sept. 9, 2005, in the Town of Carrollton.

Sharkey said in other cases, several defendants pleaded guilty and face sentencing in June:

Melanie L. Whitton, 31, of Delevan, being held in the County Jail, pleaded guilty to DWI Feb. 23 in the Town of Yorkshire. She also pleaded guilty to violating a previous probation sentence for DWI.

Stacie N. Carroll, 19, of Gowanda, pleaded guilty to second-degree attempted assault Oct. 11 in the Town of Persia, where she hurt an officer.

Neal C. Hicks Jr., 39, of Buffalo, pleaded guilty to fifth-degree attempted criminal possession of a controlled substance, crack cocaine, Oct. 28 in Olean.

Debra A. Hollowell, 45, of Olean, held in the County Jail, admitted third-degree criminal possession of crack cocaine, Aug. 17 in Olean.
