A 17-year-old suspected of attempted robbery has been charged with second-degree murder, accused of firing a fatal shotgun blast at a customer during a grocery robbery on Christmas Eve.
Latravis Cheatem of Rochester, also charged with attempted robbery, is in Monroe County Jail without bail, police said. A 15-year-old was charged with robbery and drug possession in the case, and another was in custody on a warrant for escape.
Aurelio Perez, 42, was shot once in the side and died an hour later, police said. He tried to wrestle the gun away from the masked robbers, his girlfriend, Irma Martinez, said. He was on the way to Christmas Eve dinner at her apartment.
A Cuban refugee, Perez rowed a boat for two days in 1995 to get political asylum at the U.S. Naval Station at Guantanamo Bay, Martinez said.
