City Judge Angelo J. Morinello on Tuesday fined AquaFalls $192,500 for prolonged delays in remedial work to its property at 360 Rainbow Blvd.
AquaFalls, represented by the law firm of Davis, Augell, Matteliano & Gersten, pleaded guilty to five separate violations of city ordinances at the site. The penalty represents fines of $250 per day for 154 days from the original date of the criminal complaint, May 21, until the completion of repairs Oct. 22. AquaFalls was ordered to pay the full amount by Dec. 21.
The violations included failure to keep sidewalks clean and in repair, disturbance of public walkways, failure to properly barricade unsafe walkways, failure to restore city margins in a proper manner, and creating unsafe conditions by undermining pedestrian sidewalks and the public right of way.
Mayor Vincenzo V. Anello called Morinello's decision a message to property owners who ignore city ordinances.
"We will continue to be aggressive in protecting the interests of the residents of this city," he said.
"Rest assured, we have set our sights on other corporations who continue to ignore the integrity of our city's landscape."
