Ralph T. Penn Jr., a former Ceres man who has served state prison time on felony drunken driving convictions, has been indicted on charges of repeatedly having deviate sexual intercourse with a teenager two years ago, Cattaraugus County District Attorney Edward M. Sharkey said Tuesday.
Penn, 41, is currently being held in Gowanda Correctional Facility pending further court action on his new indictment, Sharkey said.
The district attorney, refusing to disclose the name or sex of the alleged victim, said Penn is charged with felony use of a child in a sexual performance, statutory rape, felony sodomy and child endangerment in connection with incidents between June and October 2002 in Portville and Salamanca.
In June 1998, County Judge Larry M. Himelein sent Penn to state prison for up to four years on his guilty plea to felony drunken driving, Sharkey said. Penn also served a brief local jail term in 1990 for drunken driving, the prosecutor added.
