5 PRISON GUARDS ADMIT DEFRAUDING STATE ON PAY

Five Orleans Correctional Facility officers pleaded guilty Wednesday in Albion Town Court to a charge of official misconduct for defrauding the state out of about $25,000 in pay.

George M. Schuster, 42, of Buffalo; Jeffrey M. Kempisty, 39, of Cheektowaga; Gary J. Peperone, 39, of Depew; and two Akron men, John J. Piscitello, 35, and Jeffrey R. Cheavacci, 37, each submitted false medical records to conceal abuse of sick leave between 1998 and 2003.

Town Justice John Gavenda sentenced all five to pay restitution and to perform 80 hours of community service within three months in exchange for a conditional discharge. If they violate either of the conditions, they could face up to a year in jail.

The restitution was calculated by multiplying the number of days in question by their daily rate of pay. Peperone owes the most, just over $15,000. They remain suspended from their jobs. With the criminal case resolved, the state will determine whether they get to return.
