MAN ADMITS TO SLAYING AND WILL SERVE 23-YEAR TERM

LOCKPORT -- Chad L. Penn on Tuesday admitted killing Emmanuel J. Boyer, and he will serve 23 years in prison for the crime.

Penn, 27, of 15th Street, Niagara Falls, accepted a plea bargain to first-degree manslaughter rather than face trial for two counts of second-degree murder and one count of second-degree criminal possession of a weapon.

Boyer, 16, was gunned down on Elmwood Avenue in Lockport on March 20.

Police reports said Boyer drove up and got into an argument with a man on the sidewalk. When Boyer got out of his car, he was shot in the chest by a man on the sidewalk.

Four days before he was killed, Boyer had pleaded guilty to the nearly fatal brick and shovel beating of a man on Elmwood Avenue Sept. 30. Police said the incident was not related to the killing. Both occurred in an area police say is known for drug activity.

Penn was caught on Lockport Road in Wheatfield less than an hour after the shooting, when sheriff's deputies stopped a car containing half a dozen people who had fled the scene. Penn, one of the occupants, was identified as the shooter by two eyewitnesses.

Assistant District Attorney Holly E. Sloma said County Judge Sara Sheldon Sperrazza committed to the 23-year sentence, which she will make official Oct. 24.

Dunkirk man gets 5 years
for burglarizing home

MAYVILLE -- A Dunkirk man has been sentenced to five years in prison for burglarizing a Brigham Road home on Sept. 4, 2000.

Shawn M. Vincent, 29, of King Street, had pleaded guilty to second-degree burglary and fourth-degree grand larceny. District Attorney James P. Subjack's office said the sentence was handed down Monday by Chautauqua County Court Judge John T. Ward. Dunkirk police said Vincent took several items from the house.

In other court cases:

Willie F. Lockett, 38, of Clymer-Corry Road, Clymer, was sentenced to three years in prison for second-degree attempted burglary.

Jose DeJesus, 22, of the Lakeview Correctional Facility, Brocton, was sentenced to 1 1/2 to three years in prison for second-degree attempted assault. Subjack said the sentence was added on to another sentence currently being served by DeJesus.

John Ortiz, 18, of Antelope Street, Dunkirk, was sentenced to six months in Chautauqua County Jail and five years' probation for third-degree arson and third-degree burglary.

Jose J. Leon, 32, of West Fourth Street, Dunkirk, was sentenced to six months in the county jail and five years' probation for second-degree sodomy and endangering the welfare of a child.

Franklinville man held
on first-degree rape charge

FRANKLINVILLE -- A Franklinville man has been committed to the Cattaraugus County Jail in lieu of $5,000 bail on a first-degree rape charge.

The Cattaraugus County Sheriff's Department said Tuesday that Matthew M. Cobado, 28, of Rushford Road, was arrested on the complaint of a 22-year-old Franklinville woman after an investigation and arraigned in Town Court.
