N. Tonawandan is fugitive
after skipping sentencing

BELMONT -- David W. Banko, 43, North Tonawanda, became a fugitive from Allegany County on Friday when he failed to show up for sentencing in county court.

Assistant District Attorney John A. Cappellini said Judge James E. Euken signed an arrest warrant for Banko when he skipped his date to be sentenced on a felony conviction of driving while intoxicated.

Cappellini said Banko had pleaded guilty to the charge April 23, satisfying that count and one of first-degree aggravated unlicensed operation of a motor vehicle.

Banko had been stopped July 2 on Route 243 in Rushford and was found to be drunk and driving without benefit of a license, Cappellini said.

The Sheriff's Department said Sunday that Banko remained at large.
