TOWN BOARD ASKED TO APPEAL CLOSING OF RAILROAD CROSSING

Several residents spoke out Monday night against the pending closing of a Reinhardt Road railroad crossing in the Town of Alden. They urged Town Board members to go to State Supreme Court to keep the crossing open.

State Department of Transportation Administrative Law Judge Peter Loomis ruled last fall that the crossing needs to be closed for safety reasons.

"If there is an ability of the town for appeal, they should appeal," said Maureen Dunford, a Reinhardt Road resident.

Supervisor Richard Savage said he did not know if the town can appeal the DOT ruling. He said it is not certain if the town will appeal the decision, even if it learns it can. "It burns me up that the order did not disclose that there is an appeals process," Savage said.
