City Judge John L. LaMancuso on Friday ordered James E. Lewis Jr. to remain jailed pending action by a Chautauqua County grand jury in the Sept. 15 near-fatal shooting of city Police Officer David Mitchell.

Following a preliminary hearing in the first-degree attempted murder case, LaMancuso ruled prosecutors had established probable cause to support action by a grand jury. He remanded Lewis, 18, of Allen Street, to the Chautauqua County Jail in Mayville pending grand jury action. Chautauqua County District Attorney James Subjack said he has not scheduled grand jury action.

Mitchell, who had worked undercover as part of the Southern Tier Regional Drug Task Force, remains in critical condition in a coma in Erie County Medical Center, Buffalo. He was shot in the face at near point-blank range.

Lewis, shot in the abdomen by Mitchell's partner, is charged with two counts of first-degree attempted murder. Police said Lewis contacted Mitchell to arrange a meeting intent on killing both officers.
