A judge has decided to strip Playboy of its cover for a special October newsstand edition featuring a former women's champion of the World Wrestling Federation.
U.S. District Judge Loretta A. Preska told lawyers she will issue a temporary restraining order today, forcing Playboy to redesign its Oct. 19 newsstand edition featuring nude pictures of Sable, whose real name is Rena Mero.
Playboy lawyer David Francescani said the judge is forcing the magazine to reprint 500,000 copies of the edition to conform with laws that protect trademarks.
Francescani had tried to convince the judge that Playboy had a constitutional right to use the name Sable to refer to Ms. Mero.
The judge had questioned a headline across the top of the cover: "The woman you loved as Sable in the Raw."
Francescani said it was an obvious reference to the fact that Sable would be nude in the magazine. WWF lawyer Terrence Budd disagreed, saying the line was an obvious reference to the WWF's trademarked "Monday Night Raw" cable television program.
