BANKO SPARED LONGER TERM FOR PROBATION VIOLATION

A judge today spared Stephen T. Banko IV, son of Mayor Masiello's top aide, additional jail time but told him he will spend at least several months in custody thinking about the trouble he has caused his parents and himself with his drug-related crimes.

Erie County Judge Michael L. D'Amico ordered Banko, 23, to serve a one-year term in the Erie County Correctional Facility for violating the probation he gave him some six months ago on attempted burglary charges.

The sentence is to be served concurrently with one Cheektowaga Town Justice Thomas Kolbert imposed previously on another probation violation. That charge was linked to his petit larceny and resisting arrest at a Cheektowaga store in October 1996.

D'Amico told Banko that his parents have worried about his well-being, and ordered him to turn around in the courtroom and greet his father and his mother.
