A Buffalo man has been charged with vehicular manslaughter in connection with a weekend car accident on the Cattaraugus Reservation that resulted in the death of his passenger.
A vehicle driven by Kevin Asturias, 21, of Clark Street, was speeding west on Route 20 around 5 p.m. when it passed another vehicle on the right just before Milestrip Road, according to Sgt. Gary Horton and Deputy Bradley Roth of the Erie County Sheriff's Department.
Police said Asturias' vehicle struck the front of a small truck stopped on Milestrip Road waiting to make a right turn onto Route 20.
According to police, Asturias left the scene of that accident, then drove another 600 feet on Route 20, left the road on the north side and drove along the embankment for more than 200 feet, deputies said. The vehicle hit a tree, spun 180 degrees, traveled another 180 feet and landed in a ditch, police said.
Asturias was taken by Mercy Flight to the Erie County Medical Center, where he is being treated for a serious head injury. His passenger, Alan Dale Larkin, 37 of Perrysburg, was taken to Lake Shore Intercommunity Hospital in critical condition with a massive head injury. Larkin was pronounced dead a short time later. Deputies said he had not been wearing his seat belt.
Police said Asturias was charged with driving at an imprudent speed, reckless driving, driving while intoxicated, vehicular manslaughter and several vehicle and traffic law violations. Until he is arraigned this week, he will be treated and held in the secure lockup at ECMC, where he was listed in fair condition Sunday.
