The Erie County grand jury weighing testimony in the fatal beating of a Kenmore woman could vote on whether to indict Brian R. Hilligas as early as today, according to sources.
Tuesday, under court order, Kathleen Hilligas -- the mother of the man suspected of killing 28-year-old Kathleen A. Fellner -- was questioned by prosecutors for 30 minutes in front of the grand jury.
Mrs. Hilligas is said to have told her son to go to police after the Nov. 23 slaying in his home on East Hazeltine Avenue, Kenmore.
Mrs. Hilligas and her attorney, Mark J. Mahoney, declined to comment as they left the grand jury chambers.
Jailed for more than a month, Hilligas, 28, is charged with fatally beating Ms. Fellner, his girlfriend.
Tuesday, Hilligas' attorneys, Vincent E. Doyle III and Terrence M. Connors, said they have not yet decided whether Hilligas should testify before the grand jury.
Monday, State Supreme Court Justice Mario J. Rossetti ordered Mrs. Hilligas to answer all questions before the grand jury, rejecting her claim of parent-child confidentiality.
