A 73-year-old man was arrested Tuesday after being accused of offering untaxed cigarettes for sale from his Main Street business, police said.
Adelio Mistriner of McKoon Avenue was charged with attempting to evade the state cigarette tax and possession of untaxed cigarettes for the purpose of sale by state tax investigators, police said.
Mistriner, owner of a news shop at 1324 Main St., was accused of having nine cartons and one package of unstamped, untaxed cigarettes in a wooden cabinet behind the store counter when state tax investigators visited the store on Sept. 16, according to City Court documents.
Mistriner pleaded innocent to the charges and was granted an adjournment until a Nov. 18 pretrial hearing by City Court Judge Robert M. Restaino.
State tax investigators said Mistriner told them he was selling the untaxed cigarettes because his business had been burglarized too many times, costing "thousands of dollars," according to court documents.
